Unless otherwise negotiated and stated in a written manner, by commissioning me, you agree to follow these Terms of Service (TOS).

Licence

Unless otherwise negotiated, the rights to own, publish, reproduce, modify and exploit the Commission and Work in Progress (WIP) will be as stated below.

  • Artist’s Rights

    • The Artist can use the Commission and WIP for the Artist’s social media account, portfolio, commission sample, etc. as seen appropriate, with a watermark.

  • Client’s Rights

    • For Personal Use: The Client can publish, reproduce, modify, and modify the Commission freely. The Client cannot use the Commission for any direct or indirect financial gain.

    • For Commercial Use: The Client can publish, reproduce, modify, and modify the Commission freely. The Client may use the Commission for any direct or indirect financial gain, except for NFT.

  • If the Client does not want the Artist to publicize the Commission and/or WIP, please inform the Artist in advance.

  • If the Client violates TOS, the Artist reserves all the rights of the Commission without returning the payment.

  • If the Artist has not yet received the full payment, the Client has no right over the Commission in all cases.

  • Crediting the Artist is not required, but highly appreciated.

Commission Accepting

  • The Artist has the right to decline any Commission request without needing to explain the reason.

  • The Artist does not accept the Commission for NFT.

Commission Cancellation and Refund

  • If the Artist is the one who cancels the Commission for a personal reason, the refund will be paid to the Client.

  • The Client can cancel the Commission before the start of the work. In this case, the Client must inform the Artist more than 7 days before reaching the queue, or they would have to pay for the fee (10% of the Commission’s full payment).

  • The Client can cancel the Commission after the start of the work, but the Artist reserves the right to not return the deposit. If the Commission has already reached the painting stage, the Artist reserves the right to ask for the extra payment according to the percentage done of the work.

Editing Request

  • Before the start of the work, the Client could edit the details of the Commission freely. The price will be adjusted according to the new details as well.

  • Major changes (e.g., pose, background) are only possible in the sketch stage. During the working process, the Client could ask for minor changes 5 times for free. Other kinds of editing requests will be charged extra cost depending on the complexity of the request.

  • If it is the Artist’s error, such as misreading the Commission details, there will be no extra cost for the request.

  • After the Client has received the finished Commission piece, the Artist reserves the right to not accept any editing request as stated previously. A new Commission order is required for editing requests in this condition. 

Payment

  • The Client must make the payment through the following methods. The detail will be sent through a personal message. Kasikornbank (ฺBaht)
    Paypal (USD)

  • The payment must be made within 7 days after the notice (Approval of the sketch and finished work). The Client must notify the Artist in advance if they could not make the payment in time, or the lateness will be counted as TOS violation which leads to the contract termination.

Miscellaneous

  • The Client can postpone the deadline, but the Client cannot arrange it to an earlier date than that previously scheduled. If the latter is the case,

  • the Artist may charge extra cost or cancel the Commission. This kind of cancelation is not counted as a personal reason as stated in the topic “Commission Cancellation and Refund”.

  • The Artist will keep the Commission file in Google Drive or other file storage services for 7 days, and in the Artist’s computer for 3 months from the date that the finished Commission file is sent. Within this period the Client can request the Commission file again in case of the file lost. The

  • Artist has no responsibility to give the Client the Commission file after these 3 months. If there is some incident that makes the Artist unable to give the Commission file within this period (e.g., the Artist’s computer broke down), both the Artist and the Client can negotiate for the best solution later.
